Frank A. Custode is the Chair of Curcio Mirzaian Sirot LLC’s Employment Law Practice Group. Mr. Custode focuses his practice on the representation of clients in employment law matters, including matters involving employment discrimination, wrongful discharge, hostile work environment, whistleblower retaliation, family and medical leaves of absence, disability accommodations, breach of restrictive covenants, unfair competition, and misappropriation of trade secrets. In addition to his substantial experience handling a wide variety of employment litigation, Mr. Custode has extensive experience providing clients with employment law counseling. He provides employment law counseling to individuals, including counseling on issues related to employment agreements, non-competition, non-solicitation and confidentiality agreements, and severance agreements. He also provides employment law services to management that is designed to minimize the risk of employment litigation, including providing day-to-day employment law counseling, conducting anti-harassment training, conducting workplace investigations, preparing employment-related agreements, and developing employee policies and handbooks.
Prior to joining Curcio Mirzaian Sirot LLC, Mr. Custode operated his own law practice where he primarily focused on the representation of employees in employment law matters. Prior to operating his own law practice, Mr. Custode primarily represented management in employment law matters at both a national employment and labor law firm as well as a large New Jersey-based law firm. Mr. Custode utilizes his significant experience representing both management and employees in employment law matters to provide his clients with strategic and practical legal counseling.
Mr. Custode is a New Jersey Court Rule 1:40 qualified mediator. As a mediator, Mr. Custode has a strong understanding of the issues that are important to both sides in an employment law dispute, which helps him facilitate settlement dialogue.
Mr. Custode is the author of several employment law publications and has been a presenter on a variety of employment law topics. He has been named to the New Jersey Super Lawyers list from 2017-2019 and the New Jersey Super Lawyers “Rising Stars” list from 2013-2015, which are issued by Thomson Reuters (a description of the selection methodology for both lists may be found at www.superlawyers.com/about/selection_process_detail.html). Prior to entering private practice, Mr. Custode served a judicial law clerk to the Honorable Joseph A. Falcone, A.J.S.C., Superior Court of New Jersey, Essex County.
