Frank A. Custode has nearly 20 years of experience as an employment law practitioner and is the Chair of the CMS Employment Law practice group. Mr. Custode focuses his practice on the representation of individuals in employment law matters including cases involving employment discrimination, wrongful discharge, harassment and hostile work environment, unlawful retaliation and whistleblower claims, family and medical leaves of absence, disability accommodations, and breach of restrictive covenants. Mr. Custode’s practice includes providing general employment law counseling to individuals as well as negotiating all types of employment-related agreements on behalf of individuals including employment agreements, non-compete agreements, and severance agreements. He also provides general employment law services to the firm’s corporate clients.
Prior to transitioning his practice to CMS, Mr. Custode operated his own law practice as a solo employment law practitioner. Before that, Mr. Custode represented employers for over a decade at Porzio, Bromberg & Newman, P.C., which is a one of New Jersey’s highly regarded big law firms, and Littler Mendelson P.C., which is one of the nation’s top employment law firms. Mr. Custode utilizes his well-rounded and wide-ranging experience representing both management and employees to provide his clients with strong advocacy as well as strategic and practical legal counseling.
Mr. Custode is a New Jersey Court Rule 1:40 qualified mediator. Given his diverse employment law background, Mr. Custode conducts mediations with a detailed understanding of the issues that are important to both sides in an employment law dispute.
Mr. Custode is the author of several employment law publications and has been a presenter on a variety of employment law topics. He has been named to the New Jersey Super Lawyers list from 2017-2019 and the New Jersey Super Lawyers “Rising Stars” list from 2013-2015, which are issued by Thomson Reuters (a description of the selection methodology for both lists may be found at www.superlawyers.com/about/selection_process_detail.html). Prior to entering private practice, Mr. Custode served a judicial law clerk to the Honorable Joseph A. Falcone, A.J.S.C., Superior Court of New Jersey, Essex County.
